1. Хто відповідає за ваші дані

Контролером (адміністратором) персональних даних у значенні ст. 4 п. 7 Регламенту (ЄС) 2016/679 (Загальний регламент про захист даних, далі GDPR) є:

PANCORE GROUP - торговельна назва (бренд), під якою працює сайт pancore.eu. Далі «ми», «нас», «наш» означає контролера, зазначеного вище.

Ми не призначали інспектора з захисту даних, оскільки ст. 37 GDPR цього не вимагає за характером і обсягом нашої обробки. З усіх питань щодо персональних даних пишіть на office@pancore.eu або поштою на адресу вище з позначкою «Захист даних».

2. Сфера дії

Політика стосується обробки персональних даних, коли ви:

• переглядаєте сайт pancore.eu та його піддомени (зокрема stats.pancore.eu);
• надсилаєте запит через форму на сайті;
• листуєтеся з нами електронною поштою або в Telegram за контактами, вказаними на сайті.

Ми працюємо переважно з юридичними особами, тому найчастіше обробляємо робочі контактні дані представників компаній. Політика не поширюється на сайти третіх осіб, на які ведуть посилання з нашого сайту: для них діють їхні власні правила.

Терміни вживаються у значенні GDPR. «Дані» далі означає персональні дані, тобто будь-яку інформацію про особу, яку можна ідентифікувати.

3. Які дані ми обробляємо, навіщо і на якій підставі

Дані ми отримуємо безпосередньо від вас (те, що ви вводите чи надсилаєте) або автоматично від вашого браузера під час відвідування сайту.

3.1. Перегляд сайту (технічні дані)

Дані

IP-адреса, дата й час запиту, адреса сторінки чи файлу, сторінка, з якої ви перейшли (referrer), тип і версія браузера та операційної системи (user-agent), код відповіді сервера, обсяг переданих даних.

Мета

показ сайту, його стабільна й безпечна робота, виявлення та усунення збоїв, захист від атак і зловживань.

Підстава

наш законний інтерес у безпечній і справній роботі сайту (ст. 6 ч. 1 п. f GDPR).

Строк

журнали сервера зберігаються до 30 днів; запис, потрібний для розслідування конкретного інциденту безпеки, зберігається до завершення розслідування.

3.2. Мережа доставки та захисту Cloudflare

Сайт працює через мережу Cloudflare: запити до pancore.eu проходять через сервери Cloudflare, які кешують і пришвидшують сторінки, шифрують з’єднання та відфільтровують атаки (DDoS, шкідливих ботів, автоматизовані запити). Для цього Cloudflare обробляє ті самі технічні дані запиту, що й наш сервер (п. 3.1), і може встановлювати строго необхідні cookie безпеки (див. Політику щодо cookie).

Підстава

наш законний інтерес у захисті сайту та відвідувачів (ст. 6 ч. 1 п. f GDPR). Cloudflare діє як наш обробник (розділ 5).

Строк

за правилами Cloudflare для журналів мережі, як правило від кількох годин до кількох днів.

3.3. Статистика відвідувань (Umami)

Для статистики ми використовуємо Umami, програму з відкритим кодом, встановлену на нашому власному сервері (stats.pancore.eu). Дані не передаються стороннім сервісам аналітики й не використовуються для реклами.

Дані

відвідані сторінки та їхні назви, сторінка переходу, тип браузера, операційної системи й пристрою, розмір екрана, мова браузера, приблизне розташування (країна, регіон, місто), визначене за IP-адресою, параметри рекламних міток посилання (UTM), якщо вони є.

Без IP і cookie

IP-адреса не зберігається: з неї, даних браузера й ідентифікатора сайту обчислюється односторонній хеш-ідентифікатор сесії із «сіллю», що змінюється щомісяця, тож відвідування однієї людини в різні місяці пов’язати неможливо. Umami не використовує cookie й нічого не записує у ваш браузер.

Мета

зрозуміти, які розділи корисні відвідувачам, і покращувати сайт.

Підстава

наш законний інтерес в аналізі використання сайту найменш інвазивним способом (ст. 6 ч. 1 п. f GDPR).

Строк

до 24 місяців, далі лише узагальнені показники без ідентифікаторів сесій.

Заперечення

ви можете заперечити проти цієї обробки (розділ 8) або заблокувати завантаження скрипта з stats.pancore.eu у браузері чи блокувальнику; на роботу сайту це не вплине.

3.4. Запит через форму на сайті

Дані

контакт, який ви вказуєте (адреса електронної пошти, номер телефону або ім’я користувача Telegram), текст повідомлення й відомості, які ви додаєте самі (ім’я, компанія, посада, позиція каталогу, сторінка, з якої надіслано запит), дата й час надсилання. Приховане поле-пастка для ботів людьми не заповнюється, його вміст не зберігається.

Мета

відповісти на запит, підготувати комерційну пропозицію, уточнити технічні вимоги, вести переговори до укладення договору.

Підстава

дії на ваш запит до укладення договору (ст. 6 ч. 1 п. b GDPR); якщо ви звертаєтеся як представник компанії, наш законний інтерес у діловому листуванні з контрагентами (ст. 6 ч. 1 п. f GDPR). Окрема згода для цього не потрібна.

Добровільність

надання даних добровільне, але без контакту ми не зможемо відповісти. Якщо ви вказуєте дані інших осіб (наприклад, колег), переконайтеся, що маєте право їх передати.

Строк

на час розгляду запиту й переговорів, а після останнього контакту ще до 3 років (строк позовної давності для вимог, пов’язаних із підприємницькою діяльністю, ст. 118 Цивільного кодексу Польщі), щоб зберегти історію домовленостей і мати змогу захистити свої права. Якщо запит переходить у договір, діє п. 3.6.

Як це працює

запит надходить на наш сервер через захищене з’єднання, коротко фіксується в службовому журналі сервера (п. 3.1) і доставляється нам листом через сервіс Resend на корпоративну пошту office@pancore.eu (Google Workspace).

3.5. Листування електронною поштою та в Telegram

Ми обробляємо адресу пошти або обліковий запис Telegram, ім’я, підпис, зміст повідомлень і вкладення з тією самою метою, на тих самих підставах і в ті самі строки, що й у п. 3.4. Повідомлення в Telegram обробляє також Telegram як самостійний контролер за власною політикою конфіденційності.

3.6. Договори та облік

Якщо після запиту ми укладаємо договір із вами або з компанією, яку ви представляєте, дані контактних осіб обробляються для виконання договору (ст. 6 ч. 1 п. b або п. f GDPR) і для виконання обов’язків з обліку й оподаткування (ст. 6 ч. 1 п. c GDPR) протягом дії договору та строків, установлених законом: облікові й податкові документи зберігаються до спливу строку давності податкового зобов’язання, як правило 5 років від кінця року, в якому сплив строк сплати податку.

3.7. Захист прав і вимоги

У разі спору ми можемо обробляти наведені вище дані, щоб встановити, реалізувати чи захистити правові вимоги (ст. 6 ч. 1 п. f GDPR), до спливу строків позовної давності.

3.8. Налаштування у вашому браузері

Мова сайту, позначка про вже показану вступну анімацію й текст запиту, перенесений з каталогу до форми, зберігаються лише у вашому браузері (cookie, локальне й сесійне сховище). Нам передається тільки мова, разом із запитом сторінки. Докладно: Політика щодо cookie.

4. Чого ми не робимо

• не продаємо, не здаємо в оренду й не обмінюємо персональні дані;
• не показуємо рекламу й не використовуємо рекламних, соціальних чи стежильних cookie та пікселів;
• не надсилаємо розсилок і маркетингових повідомлень без вашої окремої згоди;
• не ухвалюємо щодо вас рішень виключно автоматизовано й не здійснюємо профілювання (ст. 22 GDPR);
• свідомо не збираємо особливих категорій даних (ст. 9 GDPR) і даних про судимість; просимо не надсилати їх через форму.

5. Кому ми передаємо дані

Доступ до даних мають лише ті працівники й співробітники, яким він потрібен для відповіді на запит і які зобов’язані зберігати конфіденційність. Ми також користуємося послугами постачальників, що обробляють дані від нашого імені (обробники, ст. 28 GDPR) на підставі договорів про обробку даних:

Інші одержувачі, лише коли це потрібно:

• компанії, що працюють під брендом PANCORE GROUP (наприклад, виробнича чи постачальна компанія групи), якщо ваш запит стосується їхньої продукції чи послуг, на підставі нашого законного інтересу (ст. 6 ч. 1 п. f GDPR);
• бухгалтерські, юридичні та інші професійні радники, зобов’язані зберігати таємницю;
• державні органи та суди, якщо цього вимагає закон.

6. Передача даних за межі Європейської економічної зони

Деякі обробники з розділу 5 є компаніями зі США або можуть обробляти дані поза Європейською економічною зоною (ЄЕЗ). Така передача здійснюється на підставі:

• рішення Європейської Комісії (ЄС) 2023/1795 від 10 липня 2023 р. про належний рівень захисту в рамках EU-U.S. Data Privacy Framework, для компаній, сертифікованих у ній (Cloudflare, Google, DigitalOcean і Resend заявляють про таку сертифікацію);
• стандартних договірних умов, затверджених рішенням Комісії (ЄС) 2021/914, які містять договори про обробку даних цих постачальників.

Якщо для відповіді на запит дані потрібно передати компанії групи або співробітникові поза ЄЕЗ (зокрема в Україну), ми застосовуємо стандартні договірні умови ЄС і додаткові заходи захисту. Копію відповідних гарантій можна отримати на запит (розділ 14).

7. Строки зберігання

Після спливу строку дані видаляються або знеособлюються так, що особу більше не можна встановити.

8. Ваші права

Відповідно до GDPR ви маєте право:

• на доступ до своїх даних та отримання їх копії (ст. 15);
• на виправлення неточних і доповнення неповних даних (ст. 16);
• на видалення даних (ст. 17), якщо немає підстав їх зберігати;
• на обмеження обробки (ст. 18);
• на перенесення наданих вами даних у структурованому машинозчитуваному форматі (ст. 20), коли обробка ґрунтується на договорі чи згоді й здійснюється автоматизовано;
• заперечити проти обробки на підставі законного інтересу (ст. 21) з причин, пов’язаних із вашою конкретною ситуацією; проти обробки для прямого маркетингу заперечити можна завжди й без пояснень;
• відкликати згоду в будь-який момент, якщо обробка ґрунтується на згоді, без впливу на законність обробки до відкликання (ст. 7 ч. 3);
• подати скаргу до наглядового органу (ст. 77): у Польщі це Голова Управління з захисту персональних даних (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl), або до органу держави ЄС, де ви проживаєте, працюєте чи де сталося порушення.

Щоб скористатися правами, напишіть на office@pancore.eu. Ми відповімо без зайвої затримки, не пізніше ніж за місяць; у складних випадках строк може бути продовжено ще на два місяці з поясненням причин (ст. 12 ч. 3). Це безкоштовно; лише за явно необґрунтовані або надмірні запити можлива розумна плата чи відмова (ст. 12 ч. 5). Щоб не розкрити дані сторонній особі, ми можемо попросити підтвердити вашу особу.

9. Для відвідувачів з України

Якщо до обробки ваших даних застосовується законодавство України, ми додатково дотримуємося Закону України «Про захист персональних даних» від 1 червня 2010 р. № 2297-VI. Ви маєте права, передбачені ст. 8 цього Закону, зокрема знати про джерела збирання, місцезнаходження та мету обробки своїх даних, отримувати до них доступ, вимагати виправлення або знищення, відкликати згоду й захищатися від незаконної обробки. З питань захисту даних можна звернутися до Уповноваженого Верховної Ради України з прав людини (ombudsman.gov.ua) або до суду.

10. Безпека

Ми вживаємо технічних і організаційних заходів відповідно до ризиків (ст. 32 GDPR): з’єднання із сайтом лише через HTTPS із примусовим шифруванням (HSTS); прийом запитів з форми лише через захищений програмний інтерфейс із ключем доступу; фільтрація автоматизованих запитів; обмежений і контрольований доступ до сервера й пошти; договори з обробниками. Жоден спосіб передачі даних в Інтернеті не є абсолютно захищеним, тому просимо не надсилати через форму паролі, банківські реквізити карток чи інші особливо чутливі дані.

Про порушення безпеки, яке створює ризик для ваших прав і свобод, ми повідомимо наглядовий орган протягом 72 годин, а в разі високого ризику також вас (ст. 33 і 34 GDPR).

11. Діти

Сайт призначений для компаній і фахівців. Ми свідомо не збираємо дані осіб, молодших за 16 років. Якщо такі дані потрапили до нас, напишіть нам, і ми їх видалимо.

12. Посилання на інші сайти

Сайт містить посилання на Telegram та інші ресурси. Їхні власники самостійно відповідають за обробку даних, тож ознайомтеся з їхніми політиками конфіденційності.

13. Зміни політики

Ми оновлюємо політику, коли змінюються наші сервіси або вимоги законодавства. Чинна редакція завжди опублікована на цій сторінці з датою вгорі; про суттєві зміни ми повідомимо на сайті.

14. Мовні версії та контакт

Privacy and Personal Data Processing Policy

1. Who is responsible for your data

The controller of personal data within the meaning of Article 4(7) of Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR") is:

PANCORE GROUP is the trade name (brand) under which the website pancore.eu operates. "We", "us" and "our" below refer to the controller named above.

We have not appointed a data protection officer, as Article 37 GDPR does not require one given the nature and scale of our processing. For any question about personal data, write to office@pancore.eu or by post to the address above marked "Data protection".

2. Scope

This policy covers the processing of personal data when you:

• browse pancore.eu and its subdomains (including stats.pancore.eu);
• send an enquiry through the form on the website;
• correspond with us by e-mail or Telegram using the contacts shown on the website.

We work mainly with businesses, so most of the data we process are business contact details of company representatives. This policy does not apply to third-party websites linked from our website; their own rules apply to them.

Terms have the meaning given in the GDPR. "Data" below means personal data, i.e. any information relating to an identifiable person.

3. What data we process, why and on what legal basis

We receive data directly from you (what you enter or send) or automatically from your browser when you visit the website.

3.1. Browsing the website (technical data)

Data

IP address, date and time of the request, address of the page or file, referring page (referrer), browser and operating system type and version (user agent), server response code, amount of data transferred.

Purpose

delivering the website, keeping it stable and secure, detecting and fixing faults, protecting against attacks and abuse.

Legal basis

our legitimate interest in the secure and proper operation of the website (Article 6(1)(f) GDPR).

Retention

server logs are kept for up to 30 days; an entry needed to investigate a specific security incident is kept until the investigation ends.

3.2. Cloudflare delivery and protection network

The website runs through the Cloudflare network: requests to pancore.eu pass through Cloudflare servers that cache and speed up pages, encrypt the connection and filter out attacks (DDoS, malicious bots, automated requests). For this, Cloudflare processes the same technical request data as our server (section 3.1) and may set strictly necessary security cookies (see the Cookie Policy).

Legal basis

our legitimate interest in protecting the website and its visitors (Article 6(1)(f) GDPR). Cloudflare acts as our processor (section 5).

Retention

according to Cloudflare's rules for network logs, usually from a few hours to a few days.

3.3. Visit statistics (Umami)

For statistics we use Umami, open-source software installed on our own server (stats.pancore.eu). The data is not shared with third-party analytics services and is not used for advertising.

Data

pages visited and their titles, referring page, browser, operating system and device type, screen size, browser language, approximate location (country, region, city) derived from the IP address, link campaign parameters (UTM) where present.

No IP, no cookies

the IP address is not stored: a one-way hashed session identifier is computed from it, the browser data and the website identifier with a "salt" that changes every month, so visits by the same person in different months cannot be linked. Umami uses no cookies and writes nothing to your browser.

Purpose

understanding which sections are useful to visitors and improving the website.

Legal basis

our legitimate interest in analysing the use of the website in the least intrusive way (Article 6(1)(f) GDPR).

Retention

up to 24 months, after which only aggregated figures without session identifiers are kept.

Objection

you may object to this processing (section 8) or block the script from stats.pancore.eu in your browser or content blocker; the website keeps working.

3.4. Enquiries through the website form

Data

the contact you provide (e-mail address, phone number or Telegram username), the message text and any details you add yourself (name, company, position, catalogue item, page from which the enquiry was sent), date and time of submission. A hidden honeypot field for bots is not filled in by people and its content is not stored.

Purpose

replying to the enquiry, preparing a commercial offer, clarifying technical requirements, negotiating before a contract is concluded.

Legal basis

steps taken at your request prior to entering into a contract (Article 6(1)(b) GDPR); where you contact us on behalf of a company, our legitimate interest in business correspondence with counterparties (Article 6(1)(f) GDPR). No separate consent is required for this.

Voluntary

providing data is voluntary, but without a contact we cannot reply. If you include data of other people (for example, colleagues), make sure you are entitled to share it.

Retention

while the enquiry is handled and negotiations continue, and for up to 3 years after the last contact (the limitation period for claims connected with business activity, Article 118 of the Polish Civil Code), to keep a record of what was agreed and to be able to defend our rights. If the enquiry leads to a contract, section 3.6 applies.

How it works

the enquiry reaches our server over an encrypted connection, is briefly recorded in the server's service log (section 3.1) and is delivered to us as an e-mail through the Resend service to our business mailbox office@pancore.eu (Google Workspace).

3.5. Correspondence by e-mail and Telegram

We process the e-mail address or Telegram account, name, signature, message content and attachments for the same purposes, on the same legal bases and for the same periods as in section 3.4. Telegram messages are also processed by Telegram as an independent controller under its own privacy policy.

3.6. Contracts and accounting

If an enquiry leads to a contract with you or the company you represent, contact persons' data are processed to perform the contract (Article 6(1)(b) or (f) GDPR) and to meet accounting and tax obligations (Article 6(1)(c) GDPR) for the term of the contract and the periods required by law: accounting and tax records are kept until the tax liability becomes time-barred, as a rule 5 years from the end of the year in which the tax payment deadline expired.

3.7. Legal claims

In the event of a dispute we may process the data listed above to establish, exercise or defend legal claims (Article 6(1)(f) GDPR) until the limitation periods expire.

3.8. Settings stored in your browser

The website language, a flag that the intro animation has already been shown, and the enquiry text carried from the catalogue to the form are stored only in your browser (cookie, local and session storage). Only the language reaches us, together with the page request. Details: Cookie Policy.

4. What we do not do

• we do not sell, rent or exchange personal data;
• we do not show advertising and do not use advertising, social or tracking cookies or pixels;
• we do not send newsletters or marketing messages without your separate consent;
• we do not make decisions about you based solely on automated processing and do not profile you (Article 22 GDPR);
• we do not knowingly collect special categories of data (Article 9 GDPR) or criminal records data; please do not send them through the form.

5. Who we share data with

Only staff and collaborators who need the data to answer an enquiry have access to it, and they are bound by confidentiality. We also use service providers that process data on our behalf (processors, Article 28 GDPR) under data processing agreements:

Other recipients, only where necessary:

• companies operating under the PANCORE GROUP brand (for example, a manufacturing or supply company of the group) where your enquiry concerns their products or services, based on our legitimate interest (Article 6(1)(f) GDPR);
• accounting, legal and other professional advisers bound by professional secrecy;
• public authorities and courts where required by law.

6. Transfers outside the European Economic Area

Some processors listed in section 5 are US companies or may process data outside the European Economic Area (EEA). Such transfers are based on:

• Commission Implementing Decision (EU) 2023/1795 of 10 July 2023 on the adequate level of protection under the EU-U.S. Data Privacy Framework, for companies certified under it (Cloudflare, Google, DigitalOcean and Resend state that they are certified);
• the standard contractual clauses approved by Commission Implementing Decision (EU) 2021/914, included in these providers' data processing agreements.

If data needs to be shared with a group company or a collaborator outside the EEA (in particular in Ukraine) to answer an enquiry, we use the EU standard contractual clauses and supplementary safeguards. A copy of the relevant safeguards is available on request (section 14).

7. Retention periods

When the period ends, the data is deleted or anonymised so that the person can no longer be identified.

8. Your rights

Under the GDPR you have the right:

• of access to your data and to obtain a copy (Article 15);
• to rectification of inaccurate data and completion of incomplete data (Article 16);
• to erasure (Article 17) where there is no ground for keeping the data;
• to restriction of processing (Article 18);
• to data portability of the data you provided, in a structured, machine-readable format (Article 20), where processing is based on a contract or consent and carried out by automated means;
• to object to processing based on legitimate interest (Article 21) on grounds relating to your particular situation; you may object to processing for direct marketing at any time without giving reasons;
• to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal (Article 7(3));
• to lodge a complaint with a supervisory authority (Article 77): in Poland, the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl), or the authority of the EU country where you live, work or where the infringement took place.

To exercise your rights, write to office@pancore.eu. We will reply without undue delay and at the latest within one month; for complex requests this may be extended by two further months, with reasons (Article 12(3)). This is free of charge; only for manifestly unfounded or excessive requests may we charge a reasonable fee or refuse (Article 12(5)). To avoid disclosing data to someone else, we may ask you to confirm your identity.

9. Visitors from Ukraine

Where Ukrainian law applies to the processing of your data, we additionally comply with the Law of Ukraine "On Personal Data Protection" No. 2297-VI of 1 June 2010. You have the rights set out in Article 8 of that Law, including to know the sources of collection, the location and purpose of processing of your data, to access it, to request its correction or destruction, to withdraw consent and to be protected against unlawful processing. On data protection matters you may contact the Ukrainian Parliament Commissioner for Human Rights (ombudsman.gov.ua) or a court.

10. Security

We apply technical and organisational measures appropriate to the risk (Article 32 GDPR): connections to the website only over HTTPS with enforced encryption (HSTS); form enquiries accepted only through a protected interface with an access key; filtering of automated requests; limited and controlled access to the server and mailbox; agreements with processors. No method of transmission over the Internet is completely secure, so please do not send passwords, payment card details or other highly sensitive data through the form.

If a personal data breach is likely to result in a risk to your rights and freedoms, we will notify the supervisory authority within 72 hours and, where the risk is high, you as well (Articles 33 and 34 GDPR).

11. Children

The website is intended for companies and professionals. We do not knowingly collect data of persons under 16. If such data has reached us, please let us know and we will delete it.

12. Links to other websites

The website contains links to Telegram and other resources. Their owners are responsible for their own data processing, so please read their privacy policies.

13. Changes to this policy

We update this policy when our services or legal requirements change. The current version is always published on this page with its date at the top; we will announce material changes on the website.

14. Language versions and contact
